Wayne Rooney has dodged a potential three-game violent conduct charge with the FA confirming this afternoon that they will take no further action over the clash with Wigan’s James McCarthy.

Rooney appeared to lead with his elbow in a clash with the Wigan midfielder during Manchester United’s 4-0 Premier League victory on Saturday but, with referee Mark Clattenburg acknowledging the incident at the time, the FA cannot act retrospectively within the current rules.

This now means that the influential number 10 will be available for United’s two key Premier League fixtures against Liverpool and Chelsea. It will come as a massive boost for Sir Alex Ferguson as the Red Devils look to preserve their 4 point lead on second place Arsenal. In Fantasy Premier League terms, Rooney’s escape could have significant bearing.

The elbow has been a major talking point since Saturday, with many high-profile figures voicing their opinions on the matter.

Sir Alex Ferguson has accused the press of a witch hunt against Rooney:

“There is nothing in it. But, what will happen, the question has been asked and because it is Wayne Rooney the press will raise a campaign to get him hung by Tuesday or electrocuted or something like that. It is unbelievable.”

Wigan manager Roberto Martinez unsurprisingly had a different opinion to the incident:

“If my player had done that, he would have been very, very lucky to stay on the pitch. It’s clearly a red card, Rooney was very fortunate. If you see it on the television, it is clear. It is an off-the-ball incident and the elbow catches McCarthy in his face. I saw the referee at half-time and he said he felt it wasn’t a red card; that he clipped him.”

Interestingly, former referee Graham Poll offered his view in this morning’s Daily Mail, stressing the he felt it was unlikely that the FA would take further action.

“The only possibility for a charge now would come if the FA send Clattenburg a clip of the incident and ask him to reconsider. They have not done this in recent memory, however, as it is considered ‘re-refereeing’.”

It appears that Poll was accurate of his assessment of the situation but, in many camps, the failure to act on what appears to be a blatant use of the elbow by Rooney, will cause ripples of controversy throughout the Premier League. Potentially, this decision could decide the fate of the title.

In the short-term, Ferguson’s lineup for trip to Stamford Bridge tomorrow night will now be of great interest. With Rooney free to start, Ferguson must now decide whether to have him lead his attack with Nani and Ryan Giggs (if fit) flanking either side in a 4-3-3/4-5-1, or perhaps start with two strikers. That could see Dimitar Berbatov restored to the starting XI, despite Javier Hernandez’s double at the DW Stadium. Alternatively there’s every possibility that Ferguson will shift Rooney out wide, perhaps taking him out of the middle of the park melting pot in what will likely be a lively encounter, fuelled by the weekend incident. That could see Nani on the opposite flank with Berbatov or Hernandez leading the attack.

        I'll admit I've only followed EPL so long so I looked that up. The only thing I found was Keown getting punished with $5000. Not to be a dick or anything haha. But really though Ferguson should receive something similar, if only to prevent it from being blatant in the future.

        Side note: I really hope Birmingham gets dropped to Championship.

      Noone's going to get punished for anything anymore because that would require that spineless bunch of pimps at the FA to actually turn up for work before thursday afternoon and make a decision. Monday to Thursday is reserved for AR*E licking Fifa executives.

      Obviously, if an intentional taunt– very bad sportsmanship. My first thought was exactly yours Shulfc, but then I looked at it a bit more.

      Possibly, Kos was starting to get up (look at the photo) and could have been bowled over if Ferguson didn’t “direct” him to stay down, while passing at full speed. Like a father directs his four year old, who is not looking and about to crash into a glass door. May be a stretch but Ferguson has a good rep, doesn't he.

      Also, why was this goal Kos’ fault- I thought he held up kicking the clearance based on a “my ball” call from Szczeny. Have I got that totally wrong? Did Kos miss hitting the ball?

        I doubt that, you can see Kos' head snap forward and in the picture Ferguson is clearly upright. I was upset over the loss but that just made me furious, I know an attempt to physically taunt when I see it.

    Ok as everyone on here is smart and I'm dumb answer me this.

    If I write in an assignment that "the business takes a laissez-faire approach to human resource development". Would that mean laid back or something like they leave them alone to do as they please.

    Or have I completely misunderstood the word and I should stop trying to be clever?

      Laissez-faire describes an attitude to management of personnel. Autorcatic would be heavily involved, man management stuff, laissez-faire would be more of a hands off, liberal approach to management.

      Depends what you want to say I suppose, but if it is what I think you want to say I would just say relaxed, the easier the better.

        Yeah I know the management styles that sort of why I'm trying to use it. What Im saying is companies have a laissez-faire attitude to training where they leave it up to the employees to sort it out and get on with it. But not sure if that makes sense.

          It's the complete opposite to Taylorism where the work process is defined, written out and workers cannot deviate. laissaz-faire trusts the process of recruiting self motivated driven people that will pursue the best outcome because that how they get satisfaction....just like a Fantasy Football Manager...to come full circle..

    - Defender X out> Baines or Coleman or Johnson in

    - VDV or Adam or Fabs out> Cahill or Arteta or Narsi in

    - RVP or Odem out> Saha (Beckford) or Zigic (Martins) in

    Whatever the case, it seems worth to embrace the 4p hit, is this hit absolutely necessary?

          I don't think you can say he's awful at the moment. In the last few weeks he has been playing much better, still not scoring a load but playing a role in the goals.

          Rest of the season? Yeah terrible.

          His City overhead would be exhibit A. Pretty average Rooney performance at best - capped by a moment of ridiculous genius. He's capable of doing something similar tomorrow night and at Liverpool or, he could be frustrating and contribute little but a couple of bookings.

            Average is really pushing that performance up a level.

            And i wouldnt call shinning the ball via an overhead kick which has been done 1 million times b4 genius. (Genius was the goals against the likes of Pompey for me)

            All in all the fact that the match was against City made the goal 100 times better than it actually was in reality.

      I'd keep Huth and sell Vidic instead.

      Now that Rooney appears to have his groove back I doubt you'll see Vidic bombing forward much now.

      I think Baines will probably outscore Vidic from this point on now, esp with Cahill back. Huth has been Stoke's biggest goal threat from set pieces, which is what Stoke are all about.
