Wayne Rooney has dodged a potential three-game violent conduct charge with the FA confirming this afternoon that they will take no further action over the clash with Wigan’s James McCarthy.

Rooney appeared to lead with his elbow in a clash with the Wigan midfielder during Manchester United’s 4-0 Premier League victory on Saturday but, with referee Mark Clattenburg acknowledging the incident at the time, the FA cannot act retrospectively within the current rules.

This now means that the influential number 10 will be available for United’s two key Premier League fixtures against Liverpool and Chelsea. It will come as a massive boost for Sir Alex Ferguson as the Red Devils look to preserve their 4 point lead on second place Arsenal. In Fantasy Premier League terms, Rooney’s escape could have significant bearing.

The elbow has been a major talking point since Saturday, with many high-profile figures voicing their opinions on the matter.

Sir Alex Ferguson has accused the press of a witch hunt against Rooney:

“There is nothing in it. But, what will happen, the question has been asked and because it is Wayne Rooney the press will raise a campaign to get him hung by Tuesday or electrocuted or something like that. It is unbelievable.”

Wigan manager Roberto Martinez unsurprisingly had a different opinion to the incident:

“If my player had done that, he would have been very, very lucky to stay on the pitch. It’s clearly a red card, Rooney was very fortunate. If you see it on the television, it is clear. It is an off-the-ball incident and the elbow catches McCarthy in his face. I saw the referee at half-time and he said he felt it wasn’t a red card; that he clipped him.”

Interestingly, former referee Graham Poll offered his view in this morning’s Daily Mail, stressing the he felt it was unlikely that the FA would take further action.

“The only possibility for a charge now would come if the FA send Clattenburg a clip of the incident and ask him to reconsider. They have not done this in recent memory, however, as it is considered ‘re-refereeing’.”

It appears that Poll was accurate of his assessment of the situation but, in many camps, the failure to act on what appears to be a blatant use of the elbow by Rooney, will cause ripples of controversy throughout the Premier League. Potentially, this decision could decide the fate of the title.

In the short-term, Ferguson’s lineup for trip to Stamford Bridge tomorrow night will now be of great interest. With Rooney free to start, Ferguson must now decide whether to have him lead his attack with Nani and Ryan Giggs (if fit) flanking either side in a 4-3-3/4-5-1, or perhaps start with two strikers. That could see Dimitar Berbatov restored to the starting XI, despite Javier Hernandez’s double at the DW Stadium. Alternatively there’s every possibility that Ferguson will shift Rooney out wide, perhaps taking him out of the middle of the park melting pot in what will likely be a lively encounter, fuelled by the weekend incident. That could see Nani on the opposite flank with Berbatov or Hernandez leading the attack.

      I guess it happens in most sports. In AFL (Aussie Rules) there is often the case where big name players who mysteriously miss out on being reported for incidents that the lower lights get rubbed out for.

                Im not saying Utd aren't a better team with him in but i don't agree with yu saying "stats don't lie" Utd getting an extra point every two games hes played could be down to a number of other reasons. You would have to analyze each game individually and see who else was missing. Ferdinand has had a longterm injury this season, Scholes has missed a lot of games, it's not just down to Rooney.

                    hate to chip into this cyber-snogging but this is the first mistake i can think of from szczesny since he broke into the side. always feel a bit sorry for keepers that one mistake is huge for them. for example i'd say kolarov shooting into the side netting against fulham was as bad a mistake as szczesny's but as an outfield player doing something attacking you get away with it so easily.

      He’s on my team so happy days on that front but all this really does is highlight that the current law that says retrospective action can’t be taken if the referee takes action during a game needs changing. It’s a ridiculous law that the FA just use to hide behind.

      Managers are never going to stop their players behaving like this… Ferguson is defending Rooney, Wenger never sees anything etc etc so the FA need to take control… I’m tired of diving and challenges like this going unpunished and it irritates me that the FA seem reluctant to do anything.

            the precedent wasnt the elbow as such but the retrospective punishment given to Thatcher.

            I agree Rooneys elbow was not as bad but it was a red card offence. It would have affected the game and it would also mean he shouldnt play the next 3 games.

    Surprised at that decision. I may get slaughtered when I say this but I really thought the FA would make an example of a United player as they have done in the past. Not condoning Rooney's actions though ...

            Not saying they were innocent. My point was they were made an example of with excessive punishment.

            I am also not saying Rooney is innocent, in fact everyone saw what he's done. But the rules (however wrong they may be) do not allow for a retrospective punishment if the ref saw it during the game and decided not to punish it.

              "The rules". These are the rules that the FA themselves have put in place to govern the game. There is a rule that we shouldn't go faster than 70mph on the motorway, but we sometimes do.

              Why is there a reluctance or fear to break the rule in this instance so that some common sense can be applied? Far from losing face, they would actually gain respect for showing some principles and protecting the game and it's players from future incidents.

              AP, I haven't seen any posts that are irrational. Emotional maybe, but not irrational.

                I guess the reason we have "the rules" rather than "common sense" is that "the rules" are objective and "common sense" is subjective. The fault here lies with Clattenburg not the FA.

                  Come on, we're not playing a game of snakes and ladders here. The FA will have picked up the phone and discussed with Clattenburg how to play this out.

                  Perhaps "common sense" isn't the right term, but at what point can we expect a governing body to stand up and make the "right" decision - despite the rules?

                The whole point of rules is to have a common means of interpreting the laws of the game and ensuring everyone is treated consistently. If they choose to ignore the rule in this case then they are setting a precedent for other instances where they will have to do the same. If that happens then the whole purpose behind the rule is lost.

                What they can do is collectively decide to change the rule and apply that going forward. Never retrospectively.

            Doesn't happen that way, does it. Usually a big player (read player from big club) gets away with it until someone high up decides some action has to be taken and strives to make an example of said player through excessive punishment. That inconsistency is what I'm talking about.

      Not surprised as the precedent had been set. However these sort of incidents should be stamped out and the only way to do it is to have a few high-profile examples where justice is seen to be done. The message should be that the culprits will be punished whether the referee sees it or not - only then will it get into the players heads and they will start to behave themselves.

        I agree whole completely with you. The rules need changing, for sure. No denying that. Even as a United fan and wearing red tinted glasses I know that Rooney was lucky that the free kick was given. That is was eventually saved him, a technicality. However until the rules are changed, every decision needs to be made consistently adhering to said rules.

          Stretching the point here, but if Rooney had fractured McCarthy's cheek and this incident had become a criminal matter with the police being involved, should (in your opinion) the FA act (with the consequences that has to precedents and the rules) or should there be no room for re-evaluation of the incident?

            Hahaha excellent question. The rules would have prohibited them from taking a retrospective action. That part remains true irrespective of the seriousness of the injury. What they would have done is anybody's guess. Probably they would have gotten around the rule by asked the ref to say he didn't see the whole incident and gone ahead and punished the player.

            But one can beg that if there was such a serious injury then surely the ref would have taken immediate action on the field itself.

              Exactly, the FA can hide behind their own ruling when the consequences of the "mistake" are not serious enough. The frustrating thing is, they had ways of saving face (and without breaking there own rules) but they chose the easy option, to do nothing.

              I fully understand the rational line of thought, I just find it sad that a sensible (I called it "common sense" earlier) solution where the game is protected but the incident doesn't go unpunished, wasn't sought.

    Heya I need your advise again:

    BERGOVIC, stockdale
    COLEMAN,DJOUROU, HUTH, BARDSLEY, CATHCART
    Vdv, mereiles, NANI, cahill
    Rvp, BERBATOV, TEVEZ

    The small caps are doubs, I would like to play Cahill and transfere Foster in for Stockdale for my free transfere.

    Obviously I need to wait for the injury news on the small caps, but thinking about one of the following with a 4 pts hit:

    * Bergovic replaced by Hart (form)
    * Djourou replaced by Kolarov (opportunities, vs)
    * Cahill replaced by Nasri (form, lack of other good players in AR)
    * Bardsley replaced by Luiz (clean sheets)
    * Cathcart replaced by Walker (clean sheets, bps)
    * Meireles replaced by Barton (inj, vs)

    Or anything I missed 😉

      Stilicho is right. Each proposed move breaks an unwritten rule (even without a four point hit).

      Don't replace a solid healthy player with a supposed better healthy player until ALL other needs are met. Applies to your Djourou, Bergovic, Cahill, Bardsley and Cathcart moves. Meireles for Barton is one injured for another-- at the moment.

      Foster makes sense in this DGW with DGW33 on horizon. Good choice.

      Meireless, if injured, for another DGW now and in GW33 makes sense, but not for a four point hit, unless you don't have 11 players.

      Anyway, that's how I have been playing (first year player)

    The third striker spot has been bugging me for weeks. Got Rooney Tevez RVP at the moment but sort of want to downgrade one to use the money elsewhere like getting Baines in. But not sure who I'd drop, probably Rooney but then who for?

    Odemwingies fixtures are terrible, Caroll would be ok if not injured, Suarez hasn't done much to make me want him, Berbatov is too inconsistent, Bent maybe? But do I really want to triple on Villa?

      I honestly don't see what all the fuss about this is. I quite liked it actually.

      In a sense it was pretty similar (as a taunt) to when Torres scored against Wolves a few weeks back (for Liverpool), picked up the ball from in the goal and dropped it at Stearman's feet while saying something to him, to rub it in a bit.

      The Ferguson one was only a gentle, gentle shove, nothing bad.

        Obviously, if an intentional taunt-- very bad sportsmanship.

        But my take, was that Kos was starting to get up (look at the photo) and could have been bowled over if Ferguson didn't "direct" him to stay down, while passing at full speed. Like a father directs his four year old, who is not looking and about to crash into a glass door.

        Also, why was this goal Kos' fault- I thought he held up kicking the clearance based on some "my ball" call from Szczeny. Have I got that totally wrong? Did Kos miss hitting the ball?
