Wayne Rooney has dodged a potential three-game violent conduct charge with the FA confirming this afternoon that they will take no further action over the clash with Wigan’s James McCarthy.

Rooney appeared to lead with his elbow in a clash with the Wigan midfielder during Manchester United’s 4-0 Premier League victory on Saturday but, with referee Mark Clattenburg acknowledging the incident at the time, the FA cannot act retrospectively within the current rules.

This now means that the influential number 10 will be available for United’s two key Premier League fixtures against Liverpool and Chelsea. It will come as a massive boost for Sir Alex Ferguson as the Red Devils look to preserve their 4 point lead on second place Arsenal. In Fantasy Premier League terms, Rooney’s escape could have significant bearing.

The elbow has been a major talking point since Saturday, with many high-profile figures voicing their opinions on the matter.

Sir Alex Ferguson has accused the press of a witch hunt against Rooney:

“There is nothing in it. But, what will happen, the question has been asked and because it is Wayne Rooney the press will raise a campaign to get him hung by Tuesday or electrocuted or something like that. It is unbelievable.”

Wigan manager Roberto Martinez unsurprisingly had a different opinion to the incident:

“If my player had done that, he would have been very, very lucky to stay on the pitch. It’s clearly a red card, Rooney was very fortunate. If you see it on the television, it is clear. It is an off-the-ball incident and the elbow catches McCarthy in his face. I saw the referee at half-time and he said he felt it wasn’t a red card; that he clipped him.”

Interestingly, former referee Graham Poll offered his view in this morning’s Daily Mail, stressing the he felt it was unlikely that the FA would take further action.

“The only possibility for a charge now would come if the FA send Clattenburg a clip of the incident and ask him to reconsider. They have not done this in recent memory, however, as it is considered ‘re-refereeing’.”

It appears that Poll was accurate of his assessment of the situation but, in many camps, the failure to act on what appears to be a blatant use of the elbow by Rooney, will cause ripples of controversy throughout the Premier League. Potentially, this decision could decide the fate of the title.

In the short-term, Ferguson’s lineup for trip to Stamford Bridge tomorrow night will now be of great interest. With Rooney free to start, Ferguson must now decide whether to have him lead his attack with Nani and Ryan Giggs (if fit) flanking either side in a 4-3-3/4-5-1, or perhaps start with two strikers. That could see Dimitar Berbatov restored to the starting XI, despite Javier Hernandez’s double at the DW Stadium. Alternatively there’s every possibility that Ferguson will shift Rooney out wide, perhaps taking him out of the middle of the park melting pot in what will likely be a lively encounter, fuelled by the weekend incident. That could see Nani on the opposite flank with Berbatov or Hernandez leading the attack.

    Right I've seen WUM used on here a fair bit and in the context of the posts always assumed it stood for something along the lines of trolling, as this is the internet.

    But it suddenly occurred to me the other day it could stand for wind up merchant (never seen WUM used anywhere but here).

    Deliberate elbows/forearm smashes to the head are OK? Righto. Great example to the kids of today, an absolute disgrace of a decision. Who gives a toss if the ref sees it or not.. HELLO! HINDSIGHT IS A WONDERFUL THING! Look at the bloody evidence!

    This decision could genuinely effect the title race. Chelsea and Liverpool away without your main man is an entirely different proposition. Fair play to Fergie though, his words could only have helped Rooney’s cause, canny management.

    This has absolutely nothing to do with it being Rooney or anti-United which is what SAF and many Utd fans see it as. I don’t care who it is whether it be Rooney, Gerrard, Drogba or Joe Bloggs playing in the Southern Zamaretto League. How are we supposed to say to kids in Under 11 training its wrong when they do it when the FA take no action against someone at the top of the game? I wonder if it was Joey Barton or Lee Cattermole if the decision would have been different?

    As for Clattenberg, it’s no crime he didn’t see it, he wasn’t looking and was watching the ball. The crime is saying that you saw it when you didn’t. He then reacted to the crowd which he shouldn’t have done either. Throw the book at him.

            The only time you could excuse raising your arms up like that is jumping for a header to get elevation and even then you are running the risk of elbowing someone.

            In this case there is no ball, he has elbowed the player in the head and he neither gets sent off nor a retrospective ban.

            They may aswell add 1pt to Man Utd's total as they can do what the hell they like. What can we do to change a decision by the FA - Sweet FA.

                That's because it's a fundamental human response to feel wronged if the law demonstratively fails to protect the law abiding party (McCarthy) by not punishing the non-law abiding party (Rooney).

                What we'll see now is players taking the law into their own hands, and Rooney could need some protection from referees. It'll be interesting.

                  Spoken like a more eloquent George W Bush! The purpose of law is not to protect the law abiding party at all costs in all circumstances, imagine what UK law would have to look like in order for nobody ever to be able get away with committing any offence! By your precedent every time there is a "bad" decision the FA should be able to overturn it, imagine for a second what that would do to football and consider where the cure is worse than the disease.

                    I don't know whether that is a compliment or not! Probably not 😉

                    I often think emotive responses are considered a sign of weakness by more level headed, rational people when actually being moved by an event can deliver change that wouldn't otherwise occur.

                    Laws are there (in football and in society) to guide or prescribe a "correct" way of behaviour. We can think ourselves as clever for bending the rules or by cheating, so long as it goes unnoticed. It is perfectly natural however, for the wronged party and for those with a vested interest in seeing fair play (fans, parents of young footballers) to want the governing body to act when the offending action is noticed.

                    If the injustice is also "felt" by the governing body, then there exists the means to see justice served due to the deliberately ambiguous wording of many laws. Indeed, if the Law was exacting then there would be an infinite number of caveats to consider (and we wouldn't need lawyers :)). The vast majority of fans are disappointed to say the least that the FA don't care enough about the game to go to these lengths.

            Just cos things are difficult to define, does not mean we ought not to try.

            The ACTUAL law someone manages to define these tricky-to-define things all the time. The definitions arent perfect, but they are agreeable, by and large.

What makes them special enough to deserve 'watertight' definitions of violence, when a person accused of abuse would need to argue against a subjective interpretation of violence?

        It was clear on MOTD that Clatterberg was watching the ball. He may have 'seen' the Rooney assault with his peripheral vision, but that surely cannot count. To me, Rooney's thuggery recalled Ben Thatcher.
        This whole episode reeks of shady football politics. Again, SAF imposes his will and the FA respond like cowardly little bitches.

          I was embarrassed on Saturday. I look at our midfield and then i look at the likes of West Hams midfield and i think we could be in real trouble. Grella, Andrews & Pedersen were all shocking and then you compare them to the likes of Noble, Parker, O'Neil etc and we really need to invest.

          Fulham game is crucial, he has surely got to play Formica and what is the deal with Diouf? For me he'd start every game. If he plays up front he's a constant threat and even when we've played him wide right i've been really impressed with his work rate and willingness to track runners (something which most of our midfield can't be @ssed to do). Hopefully Samba will be back, put Givet back in at LB, push Olsson into LM and play like this.

              I don't think playing Salgado is a problem against Fulham. There is no doubt we need another RB soon but there is no one in the Fulham team who is much of a worry (apart from maybe Duffer if they play him on the 'wrong' wing). Plus i think we need Emerton's aggression and work ethic in central midfield.

        Agreed all the main players get away with it. Issue is the referee for me as he has seen the incident and taken no action. FA have not intervened with any decisions seen by the ref so I blame him not the fa.

    Despite the fact that Rooney's form has been suspect in the first half of the season, do United have the most potent strikers in the PL?

    I reckon any one of those 3 could go into nearly any team, perhaps excluding Chelsea.

      I agree with you but being a bit pedantic i suppose i have to say im not sure about your ratings. Bendtner the same as defoe?! I hate defoe but bendtner is about at the level of ameobi. Gyan the same as Anelka and better than Dzeko and defoe?! Then the worst one of them all lol balotelli?! I think youre allowing him being an absolute tosser to cloud your judgement there.

        Well, to be honest the biggest thing that skews me is I look at things almost entirely from a fantasy perspective. I'll breifly give my run-down of some reasons:

        Bendtner: Although admitedly he wastes chances, he often gets so many (when he plays as lone striker) that he comes good. However, I'm aware that he's not world-class, but he did do good last season.

        Gyan: One of those prospects I am excited about, but it always seems that he's too expensive to differentiate him from other strikers.

        Anelka: Poor Anelka is a great striker, but he's just not as good as Drogba and now Torres in pure skill terms. But when he needs to step up, he does deliver.

        Balotelli: Admittedly, I know little about him, but it would seem rather than being the second greatest striker in the world, he isn't even the second best striker in his own team (if selection is anything to go by).

      Kelly looks like the only mid to long term problem. He should be the first to go - provided Cahill, Tevez and Odem get through thier games this week unscathed. I'd say Djourou is your preferred replacement - but wait until later in the week before pulling the trigger - lots can happen...

    Got to say that was one miserable ff weekend.

    Didn't like the look of villa players so opted out. Fail 1.

    Subbed out adam as only had 10 players to bring in barton for a 4pt hit. Fail 2.

    Decided not to bring in rooney as didn't think he'd do the business, stuck by the now crocked rvp instead. Fail 3.

      Odem to Tevez (good long term move regardless of what Odem does tonight) and Walcott to Barton.

      Sad thing is I didn't get Young because I already have Bent and Walker and didn't want to triple up on Villa players.

            Yeah, when I woke up I saw Zimbabwe had made 296 and I was hopeful. Bitterly disappointed when I opened up the scorecard.

            Hindsight is a wonderful thing, but having him (and so having to captain him) was a pretty poor idea. Players who are only batsmen are so risky.

            Need to put some thought into which player to get for the Kenya-Canada game (basically the only other game between two real shit sides). Was thinking of just swapping Coventry for a cheap Kenyan batsmen, but will probably have to re-think that plan.

            It's the way they score goals...I guarantee you it is also the defensive philosophy. If you had to guess out of all those teams which club has gotten out to the earlier lead and played 10 behind the ball the most which club would you say would lead that list? Besides when you have a lead and sit on it or have a large lead and are only in the box long enough to put away a cross there doesn't leave time for being kicked-down in the box. It has more to do with it being a list of length of time the opposition has the ball in your box. And it isn't that far from reality to say that out of those teams that Arsenal would be most likely to have opposition marinating in their box the longest.

              Have you watched Chelsea play in the Champions League?? Try the Barcelona game 09 game, or the Liverpool 06 game.
