Damien Duff
A brace of assists took the reliable winger to five for the season and made Duff Fulham’s leading Fantasy Premier League points scorer. Duff has been rotated in and out of Martin Jol’s lineup of late but demonstrated his worth and even hinted that, if the Cottagers can get back to goalscoring ways long term, he could present an option, particularly from Gameweeks 19-22 when Fulham face three favourable home fixtures in four.

Steve Sidwell
Another unsung hero in the Fulham ranks, Sidwell was a tireless performer and capped his display with a fourth goal of the season: a strong return for a 5.1 FPL midfielder. Having started the last six, his place seems secure and, like Duff, he could well present a differential for Fulham’s kind schedule from Boxing Day onwards.

Hatem Ben Arfa
The mercurial Frenchman made his return to the Newcastle lineup and reminded of his talents with an equalising goal: his first strike in the league since Gameweek 3. Investment in Ben Arfa looks unlikely given Newcastle’s evil schedule but he’ll be a player expected to enjoy an upturn in 2013 and could yet come into the equation before the season ends.

Going Down

Dimitar Berbatov
The Bulgarian oozed class and was central to Fulham’s attacking ploys throughout; he also had opportunities to notch but the fact remains that Berbatov has now blanked in his last five league outings. With no goal, assist or bonus coming his way since his superb Gameweek 11 performance at the Emirates, it seems likely we’ll see continued sales. His price has dropped from 7.6 to 7.4 in the past two Gameweeks and the fidgeting and steady decline in ownership is likely to continue. Those that hold will be looking beyond the next two away matches and hoping for a change in fortune and, more significantly, a speedy return for Bryan Ruiz as Berbatov’s foil.

The Newcastle Defence
Despite the return of Fabricio Coloccini, Alan Pardew’s back four continued to leak goals: their only clean sheet in the last eleven matches has come against a Wigan side with 10-men for the majority of the match. Away from home, the Magpies have conceded twice in their last three trips. With Man City, United and Arsenal in their next four fixtures, it seems most unlikely that we’ll see an immediate turnaround in fortune.

        Still here? I only saw this now.
        Two friends, Nigel and Francis, are out clay pigeon shooting with handguns and their friend Aidan has tagged along as well. After Francis fails to match Nigel’s performance in hitting targets, Nigel says “hard luck buddy.” Francis reacts sharply to this, proclaiming his advanced shooting skills. Nigel responds: “sure you couldn’t kill someone with a gun even if you wanted to because you’re such a bad shot.” Francis reacts to this by shooting his gun in the direction of Nigel but aimed over Nigel’s head. Nigel instantly jumps to the ground, rolls over and fires back at Francis. The bullet does not hit Francis, it flies past him and hits Aidan. Nigel and Francis realise what has happened and run over to Aidan. They see that he is bleeding from the chest and in tremendous pain. They decide to bring Aidan to a hospital and proceed to carry him to Nigel’s car. As they pick him up, Nigel criticises Francis’s way of carrying him. Again Francis reacts sharply, taking this as an insult, and says to Nigel “you can carry him by yourself so” and runs off. Nigel half carries, half drags Aidan to his car. He drops him a couple of times on the way and, seeing that Aidan is losing consciousness, makes a quick attempt to perform CPR, by pumping Aidan’s chest, as he had seen on television. Nigel also accidentally bangs the car door against Aidan’s head when closing it after he had put him in the back seat. Nigel drives to a hospital where Aidan is given urgent attention and, despite the doctors’ best efforts, dies a short time later. The medical evidence is that Aidan’s lung had been pierced by the bullet and he had been haemorrhaging internally; rough treatment – and especially pumping of the chest – would have continued and exacerbated the internal bleeding that otherwise would not necessarily have been fatal.

        I'm currently thinking that Nigel is guilty of involuntary manslaughter while Francis would be guilty of manslaughter via negligence because he willingly entered in to a role of care for Aidan and then chose not to fulfil his role leading to Aidan being dragged on the ground which, while not a primary cause of death, was a cause of death.

          yes, still here. when francis aims over nigel's head and hits aidan, the 'doctrine of transferred malice' applies so that the mens rea of shooting at nigel applies to the actus reus of ending up shooting aidan. i'll read the rest now.

            then when nigel carries aidan and later bangs his head against the door, you need to consider whether dropping aidan is a 'novus actus interveniens': an intervening act which means francis, who caused the initial injury, is not responsible for those later injuries caused by the intervening acts of nigel.

            so essentially this problem is about: (1) doctrine of transferred malice; (2) novus actus interveniens; and (3) causation - as you say, while not a primary cause of death, a cause of death.

            gross negligence manslaughter is not an issue. this is drunken legal advice, so heed it at your peril (but i think i'm right)

              Have already looked at Gnango too, I think that was slightly different because both defendants knew that a shoot out would occur and accepted it (a joint enterprise.) The reason I suggest gross negligence is only because Francis voluntarily takes a role of caring for Aidan and then chooses not to fulfil his obligation. As a result of that there is damage done to Aidan by the rough treatment of being dragged and dropped on the ground (as you say could be a novus actus interveniens) because Francis is not there to help carry him. Really appreciate the help 😀

            i know nothing of UK laws. but would transferred malice apply (to Francis) if Francis was aiming over Nigel's head? he wasn't shooting at him, right?

            and, does the nonsense of Nigel telling him that he couldn't kill because he's a bad shot have any significance? if Nigel believed that, he wasn't firing back at someone shooting "at" him, but rather at someone who was shooting "not at" him. or is this where Nigel's comment comes into play, as might one argue that Francis became more dangerous when he was aiming above him (since he is such a bad shot)? (to tie all of this into FFS, if Bobby Zamora were to aim at Row Z when shooting, should the goalkeeper be more ready to make a save than when he is aiming at the goal???)

            as a result, does the transferred malice/intent apply to Nigel, who was shooting with the intent of hitting Francis but ends up hitting poor Aidan. wrong place, wrong time.

            and, yes, surely there is something significant in Francis starting to help, and then stopping. bad Francis.

            but, is there is a doctrine that makes the shooter responsible for these subsequent acts? it's not like he shot him and then something completely unrelated happened such as Aidan being eaten by bear. while the CPR treatment becomes a significant cause, nothing indicates that it was error to take that step. it all gets doubly or more murky since it involves the same actors, but even if someone completely new had arrived to make the hospital run and deliver the CPR, but bottom line is none of that happens without the shooting in the first place.

            again, i know nothing about any of this. good luck.

          You are on the right track. Perhaps not the correct answer just yet, but you have spotted the correct issues, as I see it: "duty" and "causation". Of course, spotting the correct issues are the first step to getting to the correct answers.

          I practice in the US, but our law is adopted from English common law. So, perhaps these ideas may be relevant:

          1) Over here, medical malpractice is not an intervening or superceding cause. If you inflict the injury, you are not excused from the end result by virtue of bad care. If someone else botches the rescue efforts, that is not a defense. Here, malpractice is deemed foreseeable. So, should you consider whether BOTH Francis and Nigel were criminally negligent in the first instance for the reckless gun play that resulted in Aiden's fatal wound?

          2) Were Francis and Nigel acting in concert in their reckless gun play? For example, when two people at a traffic light decide to race their cars down the street and one of the cars loses control and runs over a pram full of quadruplets, BOTH drivers can be found criminally liable. They were breaking the law together. It is not a defense to say, "We decided to race, but it is his fault for losing control and hitting the kids." Remember, Francis fired the first reckless shot. It is completely irrelevant that Francis missed. Rule number one: Nothing good is ever going to happen when you shoot a gun AT someone. You have a legal duty not to shoot your gun at people (unless it is legally justified; ie, self defense). So, in this instance, should you consider where Francis and Nigel were shooting and whether they were breaking the law when they decided to have their armed pissing contest? Perhaps it may be worth considering an "acting in concert" theory resulting in injury.

          3) In the US, there is no duty to rescue anyone -- ever. But, if you do start to help or resuce, you have to act as a "prudent person in the same or similar circumstances". It's an objective standard ("prudent person"), not a subjective standard. If you CAN'T get Francis on the original event -- the guy fired the first shot and got the chain of events going -- then you can start to look at the fact that he abandoned Aiden. This, however, is a potential trap that your law professor may have set for you as it may be a bit of a stretch. In the end, Francis may be guilty of being a first class as$hole for ditching his friend, but he didn't cause any additional injury.

          4) Causation: Look at the fact pattern and pinpoint exactly what the injury was that caused Aiden's death. Then, look at the mechanism of injury. Then look at who caused the mechanism of injury. For example, it appears that banging Aiden's head on the door is a red herring. Obviously, don't go down that road UNLESS there is medical evidence in the fact pattern that supports the cause of death was blunt force trauma to the head. Nigel's good faith efforts to CPR his dying buddy may also be a red herring. The "prudent person"/Nigel is not a doctor and the fact pattern does not suggest that he would have any way of knowing that the internal injuries were being exacerbated by CPR efforts. Also, as a practical matter, a jury would probably be sympathetic to Nigel because he was trying "so hard to save his friend's life" (says the defense lawyer -- as Nigel sobs, head in hand at counsel table).

          Those are just some thoughts. Good luck to you.

                  Of course, that is not to suggest FFL is unimportant. To the contrary, I was preparing for trial a couple of weeks ago and had my client in the offifce on a saturday morning getting ready for his direct examination. My client never caught on that each time I left the conference room to "get some documents" from my office, I was checking match scores to see how my FFL team was doing.     OK I think there's a new approach worth punting on til the January WC (and beyond if you dare, but these fixtures particularly suit it). If your team is reasonably template the transfers might be doable.

    Proposal: Play 4 at the back til GW21. 3 are from MUN (Rafael/Evans), ARS (Gibbs/Sagna/Mert) and LIV (Johnson/Enrique/Skrtel) - the fourth can be EVE (Baines) or MCI (Nastasic) depending on budget - their fixtures are similar. Lots of attacking defenders with strong CS chances - I'll go through the fixtures below.

    How do you afford this? Because you play a front 6 instead of a front 7. The easiest way is to downgrade to the excellent options of Sterling and Puncheon as 4th and 5th midfielders.

    Applying it to my squad, if I did Bardsley > Johnson and Sess > Bale I could play each week:

    Begovic/Foster
    Johnson Evans Sagna Baines
    Bale Fellaini Michu Sterling* Puncheon*
    RVP Suarez Lambert*

    * = Choose 1 of 3.

    My 4 defenders then have the following fixtures from GW17 to GW21:

    GW20 WBA NEW qpr CHE
    GW21 SUN wig sot new

    So you can play RVP, Suarez, the two OOP goalscoring machines Michu and Fellaini, a heavy hitter mid of your choice such as Bale, and four elite defenders with some of the best fixtures of the season and considerable attacking points.

Evans is challenged by Vida during Christmas, Nas by Lescott/Toure, Sagna by Jenkinson. All of those will give away at least one game, I expect, if not more.

        Virtually all of us have michu or Fellaini, perhaps most both. Most of us have Sterling. Most have one heavy hitter. You'd just need to downgrade one mid to puncheon. The defenders - loads jumped on the Liverpool defender bandwagon already, loads have Rafael. Two or three transfers for most I think. I'll need two.

        Haha, fair point, over the season. Chris Glover has coveted a strong trend of cs increasing in the mid season. Over that period I would not be surprised if it's the opposite. Plus, that's why I suggest just milking these good fixtures. You can win in the short term. Then WC.

        I'm still slightly annoyed at the other night , I read back text following morning and even though I Clearly apologised Initially if I was in the wrong and then after some clarification from Berbilly and Heartsattack and after posting what I was actually seeing - i then apologised again ,
        But you still went on to pontificate that I should be careful before I made accusations of double indemnity , I accept I got it wrong due to a poor 3G connection but I felt your final post cut me no slack even after I proved what I was seeing And tbh I was dissapointed with it, at one stage I was accused of being weird and smokin pot - that was a slang on my character to which I didn't deserve to which I shouldn't have implied yours to be flawed as being disingenuous in regard to double indemnity.

      I think a 4 at the back is a good tactic because its at this time of year clean sheets start to become more frequent. I don't have an expensive back line so even though I consider my team as a classic template it would be too difficult to get in those big hitting defenders.

        That's the opposite strategy and I think it's historically worked very well last year and before? One major thing pushing me away from that is that fellaini and michu are so cheap. The cash isn't so important.

          GW14: Kolarov doesn't start despite Clichy's injury, City get a CS. Baines comes close to loads of points but gets 1. Rafael gets a CS. Wisdom gets injured/dropped.

          GW15: Kolarov lasts 6 minutes before getting injured, Nastasic doesn't play, Rafael gets -1. Thank god for Baines

          GW16: Nasty and Baines get a point each, Kolarov is injured. Rafael with 9 points is on my bench because he had City away and bloody Shorey had a DGW.

            The Kolarov part is obviously a risk but by having a strong defence, you can allow for someone to come off the bench because it will be an attacking player of another decent defender, not some 4m shitter away to City/Utd etc.

            Then, when the greatest LB in FPL gets his games over the Xmas rotation and City's easy fixtures you hope for a nice double digit score.

              Yeah because defenders don't sub on often they're much more likely just to get autosubbed off. So you can take a little risk, Kolarov is possibly ok.

        Most secure looks like Rafael actually, but admittedly we're not talking 100%, absolutely, nailed on.

        At least in the 10-20% of the time defenders get rested, they are rarely subbed on, so you get tha substitute off the bench.

      Surprised you aren't considering Spurs defence with their fixtures. Vertonghen/Walker/Caulker are options and similarly priced to these guys. Caulker could be a bargain too like Sagna.

        Caulker is very well priced but I just don't trust them to deliver the CS with 2 in 15 or something. There's also uncertainty over that backline with BAE due to return, gallas hanging around like a bad smell etc. AVB is not a man I trust to do shutouts, for sure.

          Baines is 1/2m more than any of these guys and he's kept 2 CS all year. I'd trust Spurs more with their fixtures to deliver CS. They've shown signs of tightening up lately imo.

            Neville this very night ran through an analysis of spurs' problems at the back - positioning, concentration... it was a bit of a catalogue of errors. If I could count on attacking returns from an attacking player such as vertonghen then I wouldn't completely rule it out, but it looks pretty unreliable both going back and forward.

              going back? Going forward I think fixture-wise they're hard to ignore. I know he did an analysis on it but that doesn't mean they're hopeless and will never keep CS in the future. They just kept Fulham out and were it not for a comical Bale OG they would have kept Pool out. And Everton only beat them by a smash and grab right at the end. I think their tendency to concede late goals has been their flaw. But that to me is something they can overcome. I'm considering them anyway.

    I'm going to lose my h2h this week by one point because opponent is likely to get Rafael off the bench if Fletcher doesn't play tomorrow. I'm currently leading by 8 points but if he gets Rafael off the bench then he wins by a point. We both have Sess(C) to come and I'm assuming Morrison won't play so expect no points from him. I'm gutted I left Rafael on the bench myself. Is there any chance at all that Fletcher might play? MON might be desperate and play him as he wants to save his job, well that's what I'm hoping.

    My defence is a bit of mess at the moment. Morrison and Enrique injured, Clyne blank and Demel not certain of playing 90 minutes. I have 2.2M in the bank but am setting that aside to get in Bale for Sessegnon, once he's fit again, so I'm looking to transfer out one of my 4M cheapies. Best 4M cheapie at the moment? Looking at Nelsen or Davies as both have decent attacking potential, as not expecting much in terms of clean sheets.

        Yeah, that's my feeling too. But Nelsen does seem to get on the end of a fair few set-pieces and after scoring this GW might get into the habit of scoring a few. Davies looks the more consistent threat I agree.

          Agree. But instead of Rooney could get Suarez and could do that with one transfer. I just feel it is too standard. Rooney is still a bit of a differential. And United are a much better team.

          Yer I can see that too_but It's a lot to ask having 2 Strikers from same team consistently delivering. I think you need one or the other and give you options of having 2 other big scorers.

          My first choice for Utd has always been Roon and the points are bearing that out, over games played.

          And come on who is Utd's Babe in Arms!

      I guess if all those passes into the box were accurate against WBA we'd be talking about a couple of assists. He generally goes for the spectacular and tries through balls that others would not so I don't think the lack of accuracy points to anything to be majorly concerned about. It's a bit like Silva. He's constantly trying to probe the box with through balls and slipping people through. Quite a lot won't be accurate but the important thing is he's always trying them...if that makes sense.

      You'd rather 10 inaccurate passes into the box than a guy who has 1 accurate pass all game continuously. I'm rambling... 🙂
